Dakota Access Pipeline to continue despite Army Corps failure to grant easement

Energy Transfer Partners and Sunoco Logistics Partners Respond to the Statement from the Department of the Army

Energy Transfer Partners, L.P. (NYSE: ETP) and Sunoco Logistics Partners L.P. (NYSE: SXL) announced that the Administration’s statement today that it would not at this time issue an “easement” to Dakota Access Pipeline is a purely political action – which the Administration concedes when it states it has made a “policy decision” – Washington code for a political decision. This is nothing new from this Administration, since over the last four months the Administration has demonstrated by its action and inaction that it intended to delay a decision in this matter until President Obama is out of office.

For more than three years now, Dakota Access Pipeline has done nothing but play by the rules. The Army Corps of Engineers agrees, and has said so publicly and in federal court filings. The Corps’ review process and its decisions have been ratified by two federal courts. The Army Corps confirmed this again today when it stated its “policy decision” does “not alter the Army’s position that the Corps’ prior reviews and actions have comported with legal requirements.”

In spite of consistently stating at every turn that the permit for the crossing of the Missouri River at Lake Oahe granted in July 2016, comported with all legal requirements, including the use of an environmental assessment, rather than an environmental impact statement, the Army Corps now seeks to engage in additional review and analysis of alternative locations for the pipeline.

The White House’s directive today to the Corps for further delay is just the latest in a series of overt and transparent political actions by an administration which has abandoned the rule of law in favor of currying favor with a narrow and extreme political constituency.

As stated all along, ETP and SXL are fully committed to ensuring that this vital project is brought to completion and fully expect to complete construction of the pipeline without any additional rerouting in and around Lake Oahe. Nothing this Administration has done today changes that in any way.

  4. Stop the pipeline in its entirety. People world wide have spoken. Everyone needs to be concerned about the damage to Mother Earth by the continous drilling of
    holes in to the earth. And the contamination of our sacred water.
    Switching to renewable energy is a must if all living creatures are to survive. Greed is not the way.
    Everyone is suspicious of the outcome of this decision . The protectors will win. Our veterans will stand by them.

    There has never been an alternative plan as to where thousands of people,cities,and farmers,livestock,fish,and wildlife will get there water from when the pipeline leaks.Saying it will not leak or shutting off the valves is not an alternative.

  7. Wow – so how about the rule of law in the Fort Laramie Treaty of 1868? Or does that not count because it’s inconvenient?

They haven’t been granted anything, they should pick up their property and move everything off the land, until a decision has been made. these allowances such as letting these compaines proceed without full compliance lets us know what is what. these tactics the governement and these corps use are just delay tactics, as the decisions seems to me to have already been made. Who moves into a house before the money’s in the bank!

    “Transparent political actions?” I think you mean “will of the people.” Nothing in this statement even acknowledges the disastrous impact on water safety that pipelines have CONSISTENTLY caused. You don’t get to prioritize profits over peoples’ lives! I don’t care how you try to do it! The Unites States, countless veterans, and indigenous peoples will fight you left and right until this prioritization of profits over health is corrected!

  11. I guess we won’t get proof of how DAPL got agreement from the Army Corps Engineers (and 2 courts?), but Bobby Kennedy, Jr. explains rather well why this was complete BS. ETP has blatantly violated the Fort Laramie Treaty and the American Indian Religious Freedom Act of 1978. Their “security forces” have violated all civil rights of the people protecting the land and water, and their employees have consistently infiltrated the protectors, committing acts of violence to incite the law enforcement. This has been on video, livestreamed.

Their “security forces” have violated all civil rights of the people protecting the land and water, causing both the UN and Amnesty to investigate; and their employees have consistently infiltrated the protectors, committing acts of violence to incite the law enforcement.   14. That “narrow and extreme” constituency crowd-funded a million dollars in three weeks to send 2,000 vets to protest the pipeline.

    Seems there are FAR MORE people AGAINST the pipeline than for it. That makes it “wide-reaching” and “common,” far from extreme.

    The pipeline is a profit center for a corporation.
    Public welfare takes precedence over private gain.

  16. The fact is that the Dakota Access Pipeline route goes across land that is not within the United States. This land is part of another sovereign nation, and the US Federal Government, its organs, and its agents have no jurisdiction on this land. The Native Peoples of North America are the legal authorities and residents of a separate nation, as described and agreed to by the United States in hundreds of treaties.

    By attempting to use the Police, Army Corps of Engineers, or any other American institution to further the construction of this project the DAPL has demonstrated and continues to demonstrate bad faith in the United States Government and in the credibility of agreements that Government makes with all other parties.

    By now EVERY American should know, without a doubt, that this administration will say one thing & do another! Or nothing at all! That’s one thing they’ve been consistent with!

  21. Followed the law? Everyone in the entire world knows that for the lie it is. You lie about the project pretending it was a bunch of smaller projects for the sole purpose of usurping the law and foregoing a environmental impact statement. You ignored the tribe when they told you the would not have that pipeline go near their water. You set dogs on the people to cover you while you bulldozed sacred sights and artifacts. Nothing you’ve done from the moment the contract with China was signed has been legal!
